DOL, EEOC, and NLRB Plans for 2023
This course provides an in-depth analysis of the federal agencies that come under the President's jurisdiction, focusing on three primary agencies: the Department of Labor, Equal Employment Opportunity Commission (EEOC), and the National Labor Relations Board (NLRB).
In the first part of the course, we will explore the Department of Labor's regulations regarding white-collar exemptions and independent contractors, with a particular emphasis on the overtime rule. Participants will learn about the Department's plans to implement a minimum salary test for overtime eligibility, as well as the differences between exempt and non-exempt employees.
In the second part of the course, we will turn our attention to the EEOC, which is responsible for enforcing anti-discrimination laws in the workplace. We will explore the discrimination claims process, including how individuals can file a charge, initiate an investigation, and potentially file a lawsuit in federal court. Participants will learn about the various state, county, and city agencies responsible for investigating discrimination claims, as well as the challenges and concerns associated with overtime eligibility.
Finally, we will examine the National Labor Relations Board and its role in investigating and adjudicating complaints related to labor laws. We will discuss worker status and how employers may attempt to classify their employees as independent contractors to avoid liability and prevent unionization. Participants will gain a comprehensive understanding of the laws, regulations, and agencies that govern the workplace, as well as the challenges and opportunities associated with enforcing these laws.

Upon returning to the United States, he became Senior Counsel in Labor and Employment at Matkov, Salzman, Madoff & Gunn, where he spent eight years before joining Wildman, Harrold, Allen & Dixon, LLP as a Partner in Labor, Employment, and Litigation. At Wildman, he gained invaluable experience working with a broad range of clients across various industries. In 2013, Andrew was appointed Senior Assistant General Counsel at an organization in Chicago, where he provided legal support in Labor and Employee Relations. After two years, he became Managing Attorney in Labor Relations, where he oversaw the management of all labor relations matters. In 2018, he joined the University of Illinois Chicago as an Associate Director in Labor and Employee Relations, a role he held until recently when he decided to open their own private law practice.
